Terms of service

1. Purpose of this service

1) This service is an online platform to support Myanmar creators (journalists, video producers, artists, etc.)

2) We accept a wide range of donations from corporations, groups, individuals, etc. who agree with the purpose of this service.

3) Donations once accepted will not be returned for any reason.

4) Donations to Docu Athan will be used for Docu Athan's activities.

5) Regarding donations made by designating specific creators, we plan to send them for the activities of those creators as much as possible, but in the following cases, they may possibly not be used for the activities of other creators:

-1. If the creator is dead or missing.

-2. When it is recognized that the creator has clearly stopped the activity.

-3. When it is deemed difficult to perform the remittance due to domestic circumstances in Myanmar or the situation of the creator.

-4. Other cases where it is unavoidable that it is difficult to send money to the creator.

2. Application

These Terms shall apply to any and all relationships related to the use of the Service between the User and Docu Athan.

３. Usage

1. In this service, after agreeing to this agreement, the use shall be completed by the method specified by Docu Athan.

2. If Docu Athan determines that the applicant has any of the three reasons listed below, Docu Athan may not approve the use of the service, and does not bear any obligation to disclose the reason.

　　-1. when false matters are reported at the time of use.

　　-2. if the application is from a person who has violated this agreement.

　　-3. when Docu Athan determines that it is not appropriate for use.

 

4. Payment method and notes

1. In this service, donations can be made by credit card.

2. In the case of payment by card payment, the payment date will be the withdrawal date of each card company.

3. Docu Athan does not obtain user's credit card information as it uses the SQUARE service to make payments. We are unable to respond to inquiries regarding payment problems, so please contact your credit card company yourself.

4. Cancellations of donations due to customer reasons are non-refundable.

5. There is no delivery of goods for donations.

6. The donation amount includes fees required for settlement and remittance by credit companies, as well as taxes and public dues.

7. This service is not eligible for tax deductions.

 

５. Prohibited items

　Users must not engage in the following acts when using this service.

1. 　Acts that violate laws or public order and morals.

2. 　Acts related to criminal acts.

3. 　Infringement of copyrights, trademark rights and other intellectual property rights contained in this service, such as the contents of this service.

4. 　Acts of destroying or interfering with the functions of Docu Athan, other users, or other third party servers or networks.

5. 　Acts of commercially using information obtained from this service.

6. 　Acts that may interfere with the operation of this service.

7. 　Acts of unauthorized access or attempts to do so.

8. 　Acts of collecting or accumulating personal information about other users.

9. 　Acts of using this service for illegal purposes.

10. 　Acts that cause disadvantage, damage, or discomfort to other users of this service or other third parties.

11. 　Acts of impersonating other users.

12. 　Publicity, advertisement, solicitation, or sales activities on this service not authorized by Docu Athan.

13. 　Acts that directly or indirectly provide benefits to anti-social forces in relation to this service.

14. 　Other acts that Docu Athan deems inappropriate.

 

6. Suspension of provision of the Service, etc.

1) Docu Athan may suspend, suspend, or change the provision of all or part of the Service without prior notice to the User if it determines that any of the following reasons exist:

1. When performing maintenance inspections or updating the computer system related to this service.

2. When it becomes difficult to provide the Service due to force majeure such as an earthquake, lightning strike, fire, power outage, or natural disaster.

3. When a computer or communication line, etc. stops due to an accident.

4. When it is determined that there is a risk of harm to creators and management.

5. In addition, when Docu Athan deems it difficult to provide this service.

6. If it is difficult to carry out the remittance due to changes in the external environment or changes in the creator's situation.

 

2) Docu Athan shall not be liable for any disadvantage or damage suffered by the user or a third party due to suspension or interruption of the provision of this service.

7. Restrictions on Use and Cancellation of Registration

　1．Docu Athan reserves the right, without prior notice, to restrict the use of all or part of the Service or cancel the user registration if the user falls under any of the following:

1.  In case of violation of any provision of these Terms

2.  If it turns out that there is a false fact in the registered items

3. In addition, when Docu Athan determines that the use of this service is not appropriate.

 

2．Docu Athan shall not be liable for any damages incurred by the User due to actions taken by Docu Athan under this section.

 

８.  Disclaimer of Warranties and Disclaimer

1. Docu Athan does not warrant, either expressly or impliedly, that the Service is free from factual or legal defects.

2. Docu Athan shall not be liable for any damages incurred by the User arising from the use of this service, except in cases of intentional or gross negligence by Docu Athan. However, if the contract between Docu Athan and the User regarding the Service (including these Terms) constitutes a consumer contract as stipulated in the Consumer Contract Act, this exemption provision shall not apply.

3. Even in the case set forth in the proviso of the preceding paragraph, Docu Athan shall not be liable for damages arising from a special business (Document including cases where Docu Athan or the user foresaw or could have foreseen the occurrence of damages). In addition, compensation for damages incurred by the User due to default or tort due to negligence (excluding gross negligence) by Docu Athan shall be limited to the amount of donation received from the User in the month in which the damage occurred.

4. Docu Athan assumes no responsibility for any transactions, communications, disputes, etc. that arise between users and other users or third parties in relation to this service.

９．Change of service content, etc.

　Docu Athan may change, add, or abolish the contents of this service with prior notice to users, and users shall accept this.

 

10．Change of service content, etc.

　1) Docu Athan may change all or part of these Terms.

1. When the change of this agreement conforms to the general interests of users.

2. When the modification of this Agreement does not contravene the purpose of this Service Use Agreement and is reasonable in light of the necessity of modification, the appropriateness of the content after modification, and other circumstances related to modification.

　２．In the event that Docu Athan makes changes to these Terms, Docu Athan will notify users of such changes by notifying users, displaying them on the website, or by other means prescribed by Docu Athan.

11. Handling of personal information

Docu Athan does not handle personal information obtained through the use of this service.

It shall be handled appropriately in accordance with Docu Athan's "Privacy Policy".

 

12. Notice or communication

Any notice or communication between the User and Docu Athan shall be made in accordance with the method prescribed by Docu Athan. Docu Athan assumes that the currently registered contact information is valid and notifies or contacts the contact information, unless the User submits a change notification in accordance with a method separately determined by Docu Athan, it is considered to have reached the user at the time of transmission.

 

13.Prohibition of transfer of rights and obligations

The User may not transfer or pledge its status under the User Agreement or any rights or obligations under these Terms to a third party without Docu Athan's prior written consent.

 

14．Governing Law/Jurisdiction

　Japanese law shall be the governing law for the interpretation of these Terms. The court of jurisdiction shall be the Tokyo District Court or the Tokyo Summary Court.
